Notes/Comments

As part of its scientific research activity, Universidade Lusíada has been carrying out a project for the last three years aimed at understanding and disseminating the case law of the current Court of Justice of the European Union on public procurement. In fact, there is a significant lack of discussion about the Court's decisions, which this project aims to combat.

The universe of judgments and orders in question amounts to around 550, all of which will be duly organized, categorized and commented on. To aid consultation, 4 indexes have been created, 3 of which will be published immediately. The first index includes all the cases in numerical order; the second by type of case (interim measures, references for preliminary rulings and actions for a preliminary ruling by the Member States); and the third according to the criterion of the Member State or European Institutions concerned. The fourth index, which has not yet been released, identifies the rules invoked to produce the respective decision, by case.

The subject matter of the judgments and orders is divided into 30 chapters, and this thematic list is now presented in definitive form.

The deadline for the initial draft is the end of this year, 2024. The reason for publishing a version that is still incomplete and provisional is to allow interested readers to freely criticize it, and it will be up to the coordination team to analyze any suggestions that may be made.
